By accessing or using Darlyi, you represent and warrant that:

• You are at least 18 years old.
• You have the legal capacity to enter into a binding agreement.
• You are legally permitted to use the Services in your jurisdiction.
• The information you provide to Darlyi is accurate and truthful.
• You will comply with these Terms and all applicable laws and regulations.

We reserve the right to suspend or terminate accounts where we reasonably believe that a user does not meet the applicable eligibility requirements.

By creating an account or using Darlyi, you acknowledge that you have read, understood, and agreed to these Terms.

You also agree to our Privacy Policy, which explains how we collect, use, store, and process information associated with your use of the Services.

If you use Darlyi on behalf of another person, organization, or entity, you represent that you have the authority to bind that person or entity to these Terms.

Darlyi provides social and entertainment features that may include:

• Comments
• Messaging
• Audio communication
• Video communication

The Services and individual features may vary depending on your location, device, operating system, account status, and applicable laws.

We may introduce new features, modify existing features, or discontinue features at any time.

We may, at our discretion:

• Remove features
• Modify existing features
• Change functionality
• Change technical requirements
• Restrict access to certain features
• Suspend certain features

• Ensuring that use of your device complies with these Terms.

Darlyi is not responsible for damage resulting from unauthorized modifications to your device or operating system.

Certain Darlyi features may require access to device functions such as:

• Microphone
• Photos or media
• Notifications
• Location
• Contacts
• Storage
• Other device functionality

You may control these permissions through your device settings.

If you deny certain permissions, some features may not function properly or may become unavailable.

Darlyi allows users to create, upload, publish, transmit, display, and share content (“User Content”).

User Content may include:

• Photos
• Videos
• Posts
• Stories
• Comments
• Messages
• Audio
• Live content
• Profile information
• Reviews
• Reactions
• Other material submitted through the Services

You retain ownership of User Content that you own, subject to the rights and licenses granted to Darlyi under these Terms.

By submitting, uploading, publishing, or otherwise making User Content available through Darlyi, you grant Darlyi a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, process, modify where technically necessary, display, distribute, transmit, and otherwise use that User Content solely as reasonably necessary to operate, provide, maintain, promote, secure, and improve the Services.

This license continues for as long as necessary to provide the Services and for reasonable backup, security, legal, and operational purposes after removal or account termination, subject to applicable law.

You understand that content you make public may be viewed, copied, shared, or interacted with by other users.

You are solely responsible for the User Content that you submit or publish through Darlyi.

By uploading or sharing User Content, you represent and warrant that:

• You own the content or have the necessary rights to use it.
• You have permission to use any person's image, likeness, voice, or other rights contained in the content where required.
• Your content does not violate applicable laws.
• Your content does not infringe intellectual property rights.
• Your content does not violate another person's privacy rights.
• Your content does not contain unauthorized personal information.
• Your content does not violate these Terms or our policies.

You must not upload content that you do not have the legal right to distribute.

You must not use Darlyi to create, upload, distribute, promote, or transmit content that:

• Is illegal.
• Is fraudulent or deceptive.
• Infringes intellectual property rights.
• Violates another person's privacy.
• Contains unauthorized personal information.
• Promotes violence or terrorism.
• Contains threats or harassment.
• Encourages self-harm.
• Exploits or endangers minors.
• Contains sexually explicit content involving minors.
• Contains prohibited sexual exploitation.
• Impersonates another person.
• Promotes scams or fraudulent schemes.
• Contains malicious software.
• Attempts to manipulate or abuse the Services.
• Is intended to deceive other users.
• Violates applicable law.
• Violates Darlyi Community Guidelines.

You agree not to:

• Harass, threaten, stalk, or intimidate other users.
• Impersonate another person.
• Create fake or deceptive identities.
• Attempt to access another user's account.
• Collect personal information about users without authorization.
• Spam or send unsolicited communications.
• Use automated bots without our authorization.
• Scrape or extract data from Darlyi.
• Reverse engineer the Services.
• Circumvent security mechanisms.
• Interfere with the operation of Darlyi.
• Upload malware or malicious code.
• Manipulate engagement metrics.
• Use Darlyi for fraudulent activities.
• Conduct unauthorized commercial activities.
• Exploit payment systems.
• Abuse promotional offers.
• Attempt to bypass account restrictions.
• Circumvent bans or suspensions.
• Use the Services for unlawful purposes.

Darlyi enables users to interact with other people. You understand that:

• We do not conduct a complete background check on every user.
• We do not guarantee the identity of any user.
• We do not guarantee the accuracy of user-provided information.
• We do not guarantee that a user is who they claim to be.
• We cannot guarantee that every interaction will be safe.

Darlyi may provide tools allowing users to:

• Report users.
• Report content.
• Block users.
• Mute users.
• Restrict interactions.
• Report inappropriate behavior.

We may review reports and take action where appropriate. Possible actions include:

• Removing content.
• Restricting features.
• Issuing warnings.
• Suspending accounts.
• Permanently terminating accounts.
• Taking other appropriate measures.

We do not guarantee that every report will result in a particular action.

We may use automated systems, human moderators, or a combination of both to monitor and review content and activity on Darlyi.

Moderation may be performed to:

• Protect users.
• Detect prohibited content.
• Prevent fraud.
• Prevent abuse.
• Enforce these Terms.
• Enforce Community Guidelines.
• Comply with legal requirements.
• Maintain platform security.

We may remove or restrict content without prior notice where reasonably necessary.

The Darlyi Services and their underlying technology, software, design, branding, logos, trademarks, graphics, interfaces, text, and other materials are owned by or licensed to Darlyi and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not:

• Copy the Services.
• Modify the Services.
• Reproduce the Services.
• Distribute Darlyi content.
• Sell or sublicense Darlyi content.
• Reverse engineer the software.
• Create derivative works.
• Use Darlyi branding without permission.

You are granted a limited, personal, non-exclusive, non-transferable, revocable license to access and use Darlyi for lawful personal purposes in accordance with these Terms.

Darlyi names, logos, designs, trademarks, service marks, and other branding elements are owned by or licensed to Darlyi.

You may not use Darlyi branding without our prior written permission.

Third-party trademarks appearing within the Services belong to their respective owners.

Darlyi may contain integrations, links, or services provided by third parties. Third-party services may include:

• Payment providers
• App stores
• Authentication services
• Analytics providers
• Advertising services
• Cloud infrastructure
• Communication services
• Video/audio providers

Your use of third-party services may be subject to the third party's own terms and privacy policies.

Darlyi is not responsible for third-party services that we do not control.

Darlyi may offer premium features, subscriptions, virtual items, credits, digital goods, or other paid services.

Prices and applicable terms will be displayed before you complete a purchase.

You agree to pay all applicable fees, taxes, and charges associated with purchases made through your account.

We may modify pricing or discontinue paid features, subject to applicable law and any rights you may have under applicable payment or subscription terms.

Where Darlyi offers subscriptions, subscription terms will be presented before purchase.

Depending on the payment platform, subscriptions may automatically renew unless cancelled before the applicable renewal date.

Subscription management and cancellation may need to be completed through the applicable platform, including Apple App Store or Google Play.

You are responsible for reviewing the applicable subscription terms before purchasing.

Darlyi may provide virtual items, credits, coins, points, or similar digital features.

Unless expressly stated otherwise:

• Virtual items have no cash value.
• Virtual items cannot be exchanged for cash.
• Virtual items cannot be transferred outside Darlyi.
• Virtual items are licensed for use within Darlyi only.
• Virtual items do not represent ownership of money or property.

We may modify or discontinue virtual items where permitted by law.

Virtual items may be subject to additional rules displayed within the Services.

Purchases of digital products, virtual items, subscriptions, credits, or premium features may be subject to the refund policies of the payment provider or app store through which the purchase was made.

Where permitted by applicable law, digital purchases that have been delivered or consumed may be non-refundable.

Nothing in these Terms limits mandatory refund or consumer rights provided by applicable law.

You are responsible for any applicable taxes associated with your purchases or use of paid Services, except taxes that Darlyi is legally required to collect and remit.

Prices displayed within the Services may include or exclude applicable taxes depending on your location and the applicable payment platform.

We attempt to keep Darlyi available and functioning properly, but we do not guarantee that the Services will always be:

• Available.
• Uninterrupted.
• Error-free.
• Secure.
• Free from viruses or other harmful components.
• Compatible with every device.
• Available in every geographic location.

The Services may become temporarily unavailable due to maintenance, updates, technical failures, network problems, security incidents, third-party service interruptions, or circumstances beyond our reasonable control.

Darlyi may release updates, patches, improvements, security fixes, or new versions.

You may be required to install updates to continue using certain features.

Updates may be delivered automatically depending on your device and operating-system settings.

Your continued use of the Services following an update constitutes acceptance of the updated functionality and these Terms, where applicable.

We may take reasonable and lawful measures to prevent unauthorized access, misuse, fraud, or abuse of Darlyi.

These measures may include:

• Account restrictions.
• IP restrictions.
• Device restrictions.
• Rate limits.
• Security controls.
• Automated detection.
• Account suspension.
• Account termination.
• Other technical or legal measures.

We may process information necessary to identify and prevent unauthorized activity in accordance with our Privacy Policy.

We may suspend, restrict, or terminate your account if:

• You violate these Terms.
• You violate our Privacy Policy or Community Guidelines.
• You provide false information.
• You engage in fraudulent activity.

• You upload prohibited content.
• You attempt to compromise platform security.
• You misuse payment systems.
• We are required to do so by law.
• We reasonably believe suspension is necessary to protect users or Darlyi.

We may take action without prior notice where immediate action is reasonably necessary for safety, security, legal, or fraud-prevention reasons.

You may stop using Darlyi at any time.

Where available, you may delete your account through the account settings within the application.

Deleting the application from your device does not necessarily delete your Darlyi account.

You should use the account deletion functionality or contact Darlyi support if you want your account deleted.

After account termination:

• Your right to access the Services may immediately end.
• You may lose access to your account and associated features.
• Certain User Content may no longer be accessible.
• Some information may be retained where required or permitted by law.
• Provisions that by their nature should survive termination will continue to apply.

To the maximum extent permitted by applicable law, Darlyi provides the Services on an “AS IS” and “AS AVAILABLE” basis.

We do not guarantee that:

• The Services will always be available.
• The Services will be error-free.
• Content will always be accurate.
• User information will always be authentic.
• Communications will always be delivered.
• The Services will meet every user's expectations.
• The Services will be compatible with every device.

You use the Services at your own discretion and risk.

Never share passwords, financial information, authentication codes, or other sensitive information with another user.

If you decide to meet another person offline, you should take appropriate safety precautions.

To the maximum extent permitted by applicable law, Darlyi and its officers, directors, employees, affiliates, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the Services.

This may include losses resulting from:

• Loss of profits.
• Loss of business opportunities.
• Service interruption.
• Device problems.
• Internet failures.
• Third-party services.
• User interactions.
• User-generated content.
• Unauthorized account access.
• Security incidents.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Darlyi, its affiliates, officers, directors, employees, contractors, licensors, and service providers from claims, damages, liabilities, losses, costs, and expenses arising from:

• Your User Content.
• Your violation of another person's rights.
• Your violation of applicable laws.
• Your unauthorized use of the Services.

• Email.
• Push notifications.

• Account notifications.
• Updates to these Terms.

You are responsible for maintaining an accurate email address and checking important notifications associated with your account.

Your use of Darlyi is also subject to our Privacy Policy.

By using Darlyi, you acknowledge that you have reviewed our Privacy Policy.

These Terms shall be governed by and interpreted in accordance with the applicable laws of India, without prejudice to any mandatory consumer-protection or other rights that may apply to you under the laws of your jurisdiction.

Any dispute arising from or relating to these Terms or the Services shall be subject to the jurisdiction of the courts having appropriate jurisdiction under applicable law.

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full force and effect.

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision in the future.

These Terms, together with our Privacy Policy and any additional terms applicable to specific Darlyi features, constitute the agreement between you and Darlyi regarding your use of the Services, except where additional written agreements apply.
